Welcome to the TRIUMPH BRAND CENTRE (the "Brand Centre Site" or "Site")!

Information about us

This Site is hosted and operated by Adgistics Ltd ("Adgistics") on behalf of Triumph Motorcycles Limited ("Triumph", " we", " our" or " us"). We (Triumph ) are registered in England and Wales and have our registered office at Ashby Road, Measham, Swadlincote, Derbyshire, DE12 7JP .

The TRIUMPH BRAND CENTRE offers an online information and communications service that we hope you will find informative. There are a few rules that our visitors must follow when using the Site, so we ask all our visitors to read these Conditions of Use (also referred to as "User Agreement") carefully especially the disclaimers and limitations of our liability, since use of this Site constitutes your agreement with these conditions of use. If you do not agree with or accept any of these Conditions of Use, you should stop using the Site immediately. We recommend that you print a copy of this for future reference.

  • Triumph reserves the right to restrict or terminate your access to the Site at any time in its sole discretion.

You must treat your password and ID as confidential and not disclose these details to a third party. We reserve the right to disable your password and ID at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these Terms of Use.

If you know or suspect that your password or ID are known to any third party you must notify us promptly by e-mail to portalsupport@triumph.co.uk.

We may amend these Conditions of Use at any time. When we make changes, we will revise the "last updated" date at the top of the policy. If there are material changes to this statement or in how Triumph will use your personal information, we will notify you by prominently posting a notice of such changes here or on our home page, or by sending you an email. You may be required to reaffirm of your acceptance, should the changes be sufficiently significant. Furthermore, we encourage you to review this policy whenever you visit one of our sites, from time to time, as any changes will be binding on your future use of the Site.

Copyright Infringement Policy

In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws, Triumph has adopted a policy of terminating, in appropriate circumstances and at Triumph 'ssole discretion, account holders who infringe the intellectual property rights of Triumph , Adgistics Limitedor any other third party.

Conditions for use of Triumph Content

This Brand Centre Site is licensed to, and operated on behalf of Triumph, which, by and through its affiliates, subsidiaries, and licensees owns or licenses all material on this Site. Your use of any of the material or content, including without limitation any guidelines, policies, documents, logos, images, photography, films and artwork (the "Resources") that appear on the Site is subject to the following conditions and restrictions:

1. Usage Rights of Content

The content on this Site, including the Resources, are provided for general information purposes only. Except as otherwise authorized in writing by Triumph you are not permitted to:

  • Redistribute the Resources as stock photography or web art;
  • Share or disseminate the Resources to any individuals that are not employees or contractors of Triumph, to entities that do not form a part of the Triumph group of companies, to non-authorised distributors or dealers or to non-authorised press members;
  • Use any of the Resources on any product, service or communication other than that produced by or for Triumph, or by any authorised distributor or dealer, unless you are an authorised press member in which case you are permitted to use the relevant Resources to which you have access for editorial purposes only;
  • Use the Resources only for internal work purposes always acting in Triumph's best interest, and not for personal use;
  • Use the Resources for any unlawful purpose or in any way that would detrimentally impact our reputation or business;
  • Modify the Resources;
  • Use the Resources, or any modification thereof, to create obscene or scandalous works, as defined by the laws of England at the time that the work is published; or
  • Use the Resources in any way that infringes upon or violates this User Agreement or a trademark, trade name or other intellectual property right owned by any other person or company.
  • Use the Resources in electronic format, including on-line use and multi-media applications UNLESS the following conditions are met, in addition to the other restrictions contained in this User Agreement:
    • The Resources are in a format which prevents copying; and
    • The Resources comprise only a small portion of the content of the application; and
    • Any ability to download and save the Resources is disabled or otherwise not allowed.

If you access the Site from locations outside the UK, you are responsible for compliance with local laws where they are applicable.

. Trademark rights and ownership of Content and Triumph Brand Centre

Your use of the Resources on this Site is subject to the terms of this User Agreement and any other agreement between you (or your company) and Triumph . By the terms of this agreement:

  • This Site and all intellectual property rights in it including but not limited to any Resources are owned either by Triumph or Adgistics (as applicable). Intellectual property rights means rights such as: copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world). Triumph and Adgistics reserve all of their rights in any intellectual property in connection with these Terms. This means, for example, that Triumph and Adgistics remain owners of them and are free to use them as they see fit. You acknowledge that you will not assert any right, title or interest of any kind or nature whatsoever in or to the intellectual property rights contained in the Site or the Resources, nor will you challenge or contest any of Triumph's or Adgistics' rights therein.
  • Nothing in these Terms grants you any legal rights in the Site other than as necessary to enable you to access the Site. You agree not to adjust to try to circumvent or delete any notices contained on the Site (including any intellectual property notices) and in particular in any digital rights or other security technology embedded or contained within the Site.In addition to any other rights Triumph may have, your right to use the Resources on this Site is terminable upon notice from Triumph.
  • Other than as expressly provided in these Conditions of Use, nothing on this Site or arising from your use of the Content shall be construed as conferring any licence, consent, permission or other transfer of rights to you of any Intellectual Property Rights, whether by estoppel, implication or otherwise. Except as expressly set out in these Terms and Conditions, you may not reproduce, modify or in any way commercially exploit or otherwise make available any of the Resources. In particular, you may not without the prior written permission of Triumph and/or Adgistics:
    • (i) Remove any of the intellectual property or other proprietary notices or otherwise alter the same; or
    • (ii) Create a database howsoever by downloading and storing all or any Content in any form or media.
    • (iii) Use any part of the materials on our site for commercial purposes or as otherwise restricted in these terms and conditions without obtaining a licence to do so from us or our licensors.
  • All rights not expressly granted herein are reserved.

3. Limitation of Liability and Disclaimer

Subject to the above and to the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Site, the Resources or any other material and information on the Site, whether express or implied. Neither Adgistics Limited, Triumph , or its affiliates, nor anyone who helped develop, create, produce or deliver the Resources and the other material and information in this Brand Centre Site (including the Site) are liable for any losses that: (a) that were not caused by any breach on our part, or (b) were not foreseeable to you and us when these Terms of Use were formed, including but not limited to loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted management or office time and any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, except for any legal responsibility that we cannot exclude in law (such as for death or personal injury).

We use our reasonable efforts to provide accurate information, but do not guarantee it, and make no representations regarding the use or results of use of the Resources or any other material or information in this Brand Centre Site in terms of their accuracy, reliability or any other matter. We do not guarantee that this Brand Centre Site or every feature of this Brand Centre Site will remain available to you.

Triumph its affiliates and Adgistics Limited do not warrant that the functions contained in the Brand Centre Site will be uninterrupted or error-free, that defects will be corrected, that this Site or any server that makes it available is free from viruses or other harmful components, or that successful results or outcomes will result from your use of information at this Site.

Without limiting the foregoing, all information on this Brand Centre Site is provided "as is," without warranty of any kind, either expressed or implied, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

You are responsible for configuring your information technology, computer programs and platform in order to access our Brand Centre Site.

You are responsible for your own virus protection software.

In no event shall our total liability to you for any and all losses, damages, and/or causes of action, whether in contract, tort or otherwise, exceed the amount paid by you, if any, for accessing this Brand Centre Site.

The Site may contain hyperlinks or references to third party websites other than the Site. Any such hyperlinks or references are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third party website does not mean that we endorse that third party's website, products or services. Your use of a third party site may be governed by the terms and conditions of that third party site.

We shall have no liability to you for any breach of these Conditions of Use caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; or flood, fire, explosion or accident.

No one other than a party to these Terms has any right to enforce any of these Terms.

4. Termination

Notwithstanding any of these Site Terms, Triumph reserves the right, without notice and in its sole discretion, to terminate your account and/or to block your use of the Site for any reason, including if you do not comply with any part of these Conditions of Use or policies to which they refer or to any applicable law.

Privacy and Cookie policy

Triumph and Adgistics Limited reserve the right to gather information relating to the application's usage by tracking and/or contacting users. Any information gathered, as a result, is primarily for internal use to allow us to refine and improve our solution and services. We will not disclose information to a third party unless you specifically provide consent.

Full details of the way in which we use cookies on the Site and how we hold and process information from which we can identify you or any third party are set out in our Privacy and Cookie Policy and can be found at http://www.adgistics.com/brand-centre-cookie-policy.

Your use of the Site means that you must also comply with the aforementioned Privacy and Cookie Policy.

6.General Data Protection Regulation (GDPR)

Other than as outlined above, Triumph or Adgistics will not disclose your personal information without your consent unless disclosure is necessary to prevent a threat to life or health, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.

Upon your request, Triumph or Adgistics will provide you with access to your personal information unless there is an exception which applies under the General Data Protection Regulation, Data Protection Act 2018 and The Privacy and Electronic Communications - EC Directive - Regulations 2003. If we deny such access, we will tell you why.

Triumph may recover any reasonable costs incurred in providing you access to the requested information.
